3. Legal basis and consent

South African privacy law, including the Protection of Personal Information Act, 2013 (POPIA), requires personal information to be processed lawfully, fairly and for a specific purpose.

By submitting a form, booking a call, sending an enquiry, signing a mandate, applying for a rental property, attending a viewing, or providing documents, you consent to your information being used for the relevant purpose.

You may withdraw consent at any time by contacting Hannah. If you withdraw consent, it may affect the ability to continue with a relocation service, property search, rental application, mandate, sale or lease process.

Some information may still need to be retained where required by law, regulation, eXp Realty South Africa processes, FICA, transaction records or legitimate business record-keeping.

4. How information is shared

Your information is only shared where needed for the relevant service, enquiry or transaction.

This may include sharing information with:

  • eXp Realty South Africa, where your matter involves a property sale, purchase, rental, mandate, lease or regulated property transaction

  • landlords, sellers, buyers or tenants, where relevant to a property enquiry or transaction

  • conveyancers, attorneys, bond originators, mortgage providers or financial institutions

  • TPN or other tenant-screening providers, where you have consented to a credit or rental check

  • relocation partners, service providers or trusted local suppliers, where needed to support your relocation or home setup

  • website, CRM, email, form, calendar, automation, document-storage or payment providers used to run the business

  • regulators, authorities or professional bodies where legally required

Only the information necessary for the purpose will be shared.

For example, a landlord may be told that a tenant applicant has been credit checked and is suitable, but unnecessary underlying documentation should not be shared unless there is a lawful reason and appropriate consent.

5. Home Joburg and eXp Realty South Africa

Home Joburg and eXp Realty South Africa have different roles.

Home Joburg handles relocation, local guidance, concierge support, content, enquiry management and client relationship support.

eXp Realty South Africa is the registered estate agency involved where Hannah acts as a property practitioner in a sale, purchase, rental, letting, mandate, lease or property transaction.

This means:

  • relocation-only enquiries may be handled mainly under Home Joburg

  • property sales and lettings may require information to be processed under eXp Realty South Africa

  • some clients may move from Home Joburg relocation support into eXp property services

  • where a regulated property transaction is involved, eXp Realty South Africa’s compliance and record-keeping requirements may apply

6. FICA, POPIA and property compliance

Where property transactions are involved, Hannah may be required to collect and process information for FICA, POPIA, PPRA, mandate, lease, sale, purchase, conveyancing or compliance purposes.

This may include identity documents, proof of address, tax numbers, marital status, company or trust documents, bank confirmation letters or other transaction-related information.

These documents are collected only when needed and should be stored securely in the correct client or property file.

7. Marketing communication

If you opt in to receive newsletters, property updates, relocation resources or other marketing communication, your contact details may be used for that purpose.

You can unsubscribe or opt out at any time.

Marketing consent is separate from service or transaction communication. Even if you unsubscribe from marketing, Hannah may still contact you about an active enquiry, booking, relocation service, rental application, mandate, sale, lease or transaction.

8. Storage and security

Personal information is stored using business systems such as email, Google Drive, Notion, website forms, calendar tools, automation tools, CRM records, payment tools and other relevant platforms.

Reasonable steps are taken to keep information secure and to limit access to people or providers who need it for the relevant purpose.

Sensitive documents such as FICA documents, tenant-screening documents and property transaction records should be stored in secure Google Drive folders or relevant eXp systems, not uploaded casually into public or unnecessary places.

9. How long information is kept

Information is kept only for as long as needed for the purpose for which it was collected, unless a longer retention period is required for legal, regulatory, professional, tax, transaction, FICA or legitimate business record-keeping reasons.

Examples:

  • general enquiries may be reviewed and deleted if they do not become active

  • marketing contacts remain until you unsubscribe or request deletion

  • property transaction and compliance records may need to be kept for the legally required period

  • client notes may be retained where they are needed to manage an ongoing relationship or service

10. Your rights

You may ask to:

  • access the personal information held about you

  • correct inaccurate information

  • withdraw consent

  • object to certain processing

  • request deletion of information, where legally possible

  • ask how your information has been used or shared

To make a request, contact Hannah using the details below.

Some requests may be limited where information must be retained for legal, regulatory, FICA, transaction or legitimate business reasons.

11. Cookies and analytics

The website may use cookies, analytics or similar tools to understand website traffic, page performance and enquiry sources.

You can usually manage cookies through your browser settings.

If advertising, tracking pixels or advanced analytics are added later, this policy should be updated to explain what is being used and why.

12. Third-party links

The website may link to third-party websites, platforms, booking tools, payment pages, property portals, social media platforms or service providers.

This Privacy Policy does not control how those third parties process your information. You should review their own privacy policies where relevant.

13. Children’s information

Relocation enquiries may include information about children, such as school needs, ages, timing or family requirements.

This information is collected only where relevant to relocation support, school-area guidance, housing needs or family-settlement planning.

Children’s information should be kept limited, relevant and handled carefully.

14. International clients

Many Home Joburg clients enquire from outside South Africa.

If you contact Home Joburg from another country, your information may be processed in South Africa and through service providers that operate internationally.

By submitting your information, you understand that your information may be processed where Hannah, Home Joburg, eXp Realty South Africa or their service providers operate, subject to reasonable privacy and security measures.

15. Updates to this policy

This Privacy Policy may be updated from time to time, especially if services, forms, payment flows, website tools, CRM systems or legal requirements change.

The latest version should always be published on the website.
